Creationism Case: John Freshwater Lawyers Spar With Mount Vernon School Board In Ohio Bible Case

COLUMBUS, Ohio ? In a heated hour of arguments, Ohio Supreme Court justices sparred with lawyers Wednesday over the extent to which a now-fired public school science teacher had the right to push his personal religious beliefs in class.

A lawyer for the school board that dismissed John Freshwater in 2011 said he waved a Bible at his students, handed out religious pamphlets and espoused creationism in his evolution lessons.

Freshwater violated the constitutional separation between church and state and was rightfully fired, said David Smith, an attorney for the Mount Vernon School Board.

"You can't teach evolution from a Christian perspective" without violating constitutional protections against government establishment of religion, he said.

Freshwater's attorney, Rita Dunaway, said accounts of Freshwater's class conduct were exaggerated and that the instructor was exercising his academic freedom to explore controversial ideas.

"A Bible on a desk hidden amongst other clutter does not a religious display make," she said.

Dunaway said Freshwater had a laudable teaching record and his students scored well on standardized science tests.

Freshwater was dismissed in 2011 after investigators reported he preached Christian beliefs in class when discussing topics such as evolution and homosexuality and was insubordinate in failing to remove the Bible from his classroom.

Justices appeared perplexed, at times irritated, about what lawyers believed was the legal issue before them.

Justice Paul Pfeifer was incredulous when Smith argued that Freshwater's evolution class wouldn't have been covered under the school district's controversial-issues policy.

"So there's nothing controversial about evolution. It is a theory, isn't it?" he said.

Freshwater also had been accused of using a science tool to burn students' arms with the image of a cross, but that allegation was resolved and was not a factor in his firing.

Justices wanted to know Wednesday whether that incident played a role in Freshwater's dismissal. Smith speculated that attention surrounding that incident was what prompted the school board's investigation into Freshwater's 21-year career.

In its review, the board concluded Freshwater had used a high-frequency generator, which other teachers have used to demonstrate electrical current, to burn a cross onto a student's arm. The cross lasted a few weeks.

The student's family settled a federal lawsuit against the district in an effort to move on.

In his dismissal case, Freshwater is getting legal backing from the Charlottesville, Va.-based Rutherford Institute, a civil liberties group. Science education and humanist and secular groups have joined the side of the school board.

The school board argues that as far back as 1994, a middle school principal told Freshwater to stop distributing an "Answers in Genesis" pamphlet, which contained information about a creationist organization's seminar, according to a filing by board attorneys asking the court to uphold Freshwater's firing.

Freshwater also used a handout titled "Survival of the Fakest" to teach his students to doubt science, the board's attorneys said.

Two lower courts previously upheld Freshwater's dismissal.

At the back of the courtroom Wednesday, 17-year-old Esther Sorg and 18 other students from Wilmington Christian Academy about an hour southwest of Columbus were listening in as part of a school field trip.

Sorg said her science classes include evolution, and it seems public school classes could include the creationist perspective without harm.

"My eighth-grade science class was taught from a Christian perspective, but we discussed evolution as well," she said. "I thought that was good because I wanted to know what the current theories were."

Sleep reinforces learning

Feb. 26, 2013 ? During sleep, our brains store what we have learned during the day ? a process even more effective in children than in adults.

It is important for children to get enough sleep. Children's brains transform subconsciously learned material into active knowledge while they sleep -- even more effectively than adult brains do, according to a study by Dr. Ines Wilhelm of the University of T?bingen's Institute for Medical Psychology and Behavioral Neurobiology. Dr Wilhelm and her Swiss and German colleagues have published their results in Nature Neuroscience.

Studies of adults have shown that sleeping after learning supports the long-term storage of the material learned, says Dr Wilhelm. During sleep, memory is turned into a form that makes future learning easier; implicit knowledge becomes explicit and therefore becomes more easily transferred to other areas.

Children sleep longer and deeper, and they must take on enormous amounts of information every day. In the current study, the researchers examined the ability to form explicit knowledge via an implicitly-learned motor task. Children between 8 and 11, and young adults, learned to guess the predetermined series of actions -- without being aware of the existence of the series itself. Following a night of sleep or a day awake, the subjects' memories were tested. The result: after a night's sleep, both age groups could remember a larger number of elements from the row of numbers than those who had remained awake in the interim. And the children were much better at it than the adults.

"In children, much more efficient explicit knowledge is generated during sleep from a previously learned implicit task, says Wilhelm. And the children's extraordinary ability is linked with the large amount of deep sleep they get at night. "The formation of explicit knowledge appears to be a very specific ability of childhood sleep, since children typically benefit as much or less than adults from sleep when it comes to other types of memory tasks."

South Africa: Buffalo and donkey in beef products

JOHANNESBURG (AP) ? Worried about horse meat in your beef? Try water buffalo, donkey and goat.

South African food scientists said they have found all three in mislabeled foods including beef burgers, ground beef and sausages.

A study published by three professors at Stellenbosch University found that 68 percent of 139 samples contained species not declared in the product label, with the highest incidence in sausages, burger patties and deli meats.

The study found soya and gluten were not labeled in 28 percent of products tested, it found undeclared pork in 37 percent and chicken in 23 percent.

"This study confirms that the mislabeling of processed meats is commonplace in South Africa and not only violates food labeling regulations but also poses economic, religious, ethical and health impacts," co-author Professor Louwrens C. Hoffman said Tuesday.

He said tests the past two weeks on hundreds of samples of imported meat have found no horse meat.

The study, published in the latest edition of the European journal Food Control, tested compliance with new labeling laws introduced in South Africa nearly a year ago. Hoffman said it had taken years to get the legislation passed because of opposition from producers and "we are picking up the feeling that the industry is not acting on the new legislation."

He added: "We've picked up the vibe that people take all kinds of offcuts and mince it to make a sausage."

The chief executive officer of South Africa's Red Meat Producers' Association, Gerhard Schutte, called for the culprits to be prosecuted, complaining "they are giving our products a bad name."

South Africa has some of the choicest beef, lamb, pork and chicken in the world, but a complicated chain from the farm gate means products could be contaminated with other products from the abattoir to meat packers and also in the many meats imported into the country.

Hoffman said his samples for the study all were of local meat acquired from supermarkets and butchers. He said most large supermarkets hold their suppliers accountable, doing in house tests and sending samples to Stellenbosch University for verification.

He said it would not cost much for the meat industry to comply with South African labeling laws.

"It's all about people having the right to know" what they are eating, he said. "There's nothing wrong with eating donkey if you like donkey, but if you don't, you have the right to know" it is in your burger pattie or sausage.

New W3C Group Focuses on Automotive Web Platforms and ...

W3CThe World Wide Web Consortium (W3C), an international community that develops web standards, has announced the launch of the new ?Automotive and Web Platform Business Group? which will create web technology specifications for the automotive industry starting with a Vehicle Data API Specification.

There has been a rush in the creation of connected car applications and as ProgrammableWeb?s Greg Bates recently reported, car companies including Ford, GM, Toyota and BMW are racing to create vehicle-controlled app platforms and marketplaces.

The Automotive and Web Platform Business Group will focus on helping the automotive industry adopt web technologies and platforms as well as understanding W3C web specifications and standards. Specific issues related to the automobile industry will also be addressed such as reduction of driver distractions and driver safety. In the W3C press release, Roger C. Lanctot, Associate Director in the Global Automotive Practice at Strategy Analytics, states that:

?The W3C?s API initiative arrives just as OEMs are laying the groundwork to bring the browser into the car via multiple means. Car makers will be looking to the W3C to help identify best practices for over the air software updates and security and the launch of the new Business Group will provide the ideal forum for those conversations.?

Defining a Vehicle Data API Specification is the first priority of the group and will provide guidelines as to the types of vehicle data that should be accessible using a web API(s). There is a wide range of data that could be made accessible to app developers via web APIs such as vehicle make, model and year, vehicle conditions such as navigation, speed, climate and more. Diana Cheng, Web and Social Media Expert, Internet Standards, R&D at Vodafone Group states for the press release:

?Standardization of a Vehicle API will boost interoperability regardless of manufacturers and enrich automotive applications with vehicle data, which would increase security and user control. LOS ANGELES (Reuters) - Ethereal, strapless silhouettes and wavy tresses gave the Oscars red carpet a patina of old Hollywood glamour on Sunday as the year's top actresses and presenters led the way in blush, grey and black sequined gowns.

"Silver Linings Playbook" Best Actress nominee Jennifer Lawrence, 22, wowed critics with her off-white Christian Dior Couture strapless gown with a full-tiered skirt and a long necklace dropping down her back.

The actress, who is the face of Christian Dior's Miss Dior brand and has been wearing the designer to the awards leading up to the Oscars, said it was the only dress she tried on for the event.

Grounding, budget woes cloud F-35 warplane sales push in Australia

CANBERRA/WASHINGTON (Reuters) - This year's second grounding of Lockheed Martin Corp's vaunted F-35 warplane, plus looming U.S. defense cuts, are likely to complicate a push this week by Lockheed and U.S. officials to convince wary Australian lawmakers and generals to stick to a plan to buy 100 of the jets.

Australia, a close American ally, is considering doubling its fleet of 24 Boeing Co F/A-18 Super Hornets amid delays and setbacks in Lockheed's $396 billion F-35 project.

That means Canberra could buy far fewer F-35s than initially planned, at a critical time when Canada is also rethinking its plans to make the F-35 - also known as the Joint Strike Fighter (JSF) - its future frontline warplane.

Budget cuts have already forced Italy to scale back its orders, and Turkey has delayed its purchases by two years, though orders from Japan and Israel have buoyed the firm, and additional Israeli orders are expected in 2013.

Singapore has also taken a more active interest in the radar-evading jet, and South Korea is expected to announce a winner in its fighter contest late this year.

Australia and others are watching orders and problems with the jet with growing concern, since every reduction drives up the price of the remaining fighters to be built.

Given that, Friday's news that the plane was being grounded for the second time in two months, this time after a routine inspection revealed a crack on a turbine blade, was especially inopportune for Lockheed.

"It is a nuisance," said a spokesman for the Dutch defense ministry, which has already paid for two test planes but will determine the size of its total F-35 order later this year. "We wait for results of the inquiry."

Australian officials know the stakes are high.

"We're only a small player, but other countries are watching. Of course Lockheed don't want to see orders vanishing," said a source at Australia's Defense Materiel Organisation, part of the defense department, who was not authorized to speak publicly.

U.S. Lieutenant General Christopher Bogdan, the Pentagon's F-35 program chief, approved the fleetwide grounding just before leaving Washington for a major air show in Melbourne, Australia which starts this week, when it will draw attention from potential customers in Asia.

Lockheed executives have been trying to reassure Canberra that the JSF is on course. They insist that problems with software and design, including imaging and night vision functions of the pilot's helmet, are being resolved, and testing is ahead of schedule.

BUDGET CUTS

One U.S. defense official, who was not authorized to speak publicly, said the technical problems bedeviling the new fighter were less troubling than Washington's budget woes.

Sweeping budget cuts due to take effect in the United States on March 1 could cut funding for the Pentagon's biggest weapons program and delay work on seven jets this year alone.

"What the foreign partners worry about is the stability of the program writ large," said the official. "We're solving the technical challenges. There are no showstoppers there, although they're not cheap."

In the U.S., military budgets are already slated to be cut by nearly $500 billion over the next decade, an amount which could double unless Congress acts in the next week to avert spending reductions known as "sequestration".

Australia's yearly defense budget of A$26.3 billion ($27.10 billion) was cut by 10.5 percent to A$24.2 billion this fiscal year, while the military's estimated budget to 2015-16 was slashed by A$5.5 billion.

Australia will decide at the end of this year on the timing of an order for an initial 12 F-35s while it considers options to replace 71 early model F/A-18 fighter jets and a recently retired fleet of 24 Vietnam-era F-111 supersonic bombers.

After the latest grounding, a former Australian defense minister in the Labor government, Joel Fitzgibbon, criticized the country's military commanders for their "obsession" with the troubled F-35.

"I think there is an almost obsession with the JSF within the uniformed ranks. This is their brand new toy," Fitzgibbon, who still holds a senior government role, told local media.

Many defense insiders expect plans for a fleet of F-35s to be revised to feature 48 Super Hornets - 12 equipped as EA-18G Growlers with radar-jamming electronic weapons - and as few as 50 Joint Strike Fighters.

A source familiar with the matter said Canberra's decision could come within the next three to six weeks.

"The Super Hornets will eat into F-35 orders," said Sam Roggeveen, a former Australian government intelligence and arms analyst, now with the Lowy Institute security think tank.

"It's not too crude to say it will be a one for one replacement, because so far that's the kind of basis that defense has so far been working on anyway," Roggeveen said.

MASSIVE U.S. ORDER

F-35 program vice-president Steve O'Bryan and executive vice-president Tom Burbage, who is retiring at the end of next month, have travelled to visit all the program's international partners in recent weeks.

"We will continue to drop the price of the airplane out to approximately 2020 where the U.S. government estimate is for an airplane, with the engine and all mission equipment, to be approximately $67 million," O'Bryan said in Australia last week.

Lockheed is building three different models of the F-35 fighter jet for the U.S. military and eight countries that helped pay for its development: Britain, Canada, Italy, Turkey, Denmark, the Netherlands, Australia and Norway.

The Pentagon plans to buy 2,443 of the warplanes in the coming decades, although many analysts believe U.S. budget constraints and deficits will reduce that number.

The Lowy Institute's Roggeveen said the F-35 and Lockheed would survive even a serious drop in foreign orders.

"The scale of the order from the U.S. is so much bigger than international customers that Lockheed are not anywhere near the point of desperation."

(AP) ? A vow to keep his private life out of the public eye helped sweep Francois Hollande to power last year as France's president, attracting voters tired of his flashy predecessor's amorous exploits. Now, the words of the one-time dull Socialist are back to bite him in a new play.

"Mr. Normal, His Women and Me," a comedy of errors set in the Elysee Palace, is inspired by a real-life Twitter scandal involving his glamorous live-in girlfriend, journalist Valerie Trierweiler, and the elegant and influential mother of Hollande's four children, politician Segolene Royal.The affair last year shook up Hollande's carefully cultivated dull image and hurt his popularity. And immediately caught the attention of director and writer Bernard Uzan.

"When I first saw the tweet... it was a vaudeville before my eyes," said Uzan, referring to a message sent by Trierweiler during last June's legislative elections expressing support for Royal's political opponent.

Days later, Royal lost her bid for a parliamentary seat. Widely criticized as a vindictive move, the tweet went viral and dominated French media for days.

When writing the play, Uzan says he interviewed real politicians and used genuine quotes and anecdotes.

Indeed, the characters are very thinly disguised. The play features a portly, bespectacled protagonist called Francois Gouda ? named for a cheese from Holland ? who's chased around the Elysee by an obsessive ex-partner, Marjolaine Loyal, and bossy First Lady Nathalie Valtriere, who likes designer dresses.

Though it is fictional, the play ? which opened on Jan. 24 ? points out some uncomfortable truths about the last nine months, which have seen Hollande's popularity plunge at the same speed as the country's economic fortunes.

"I, as President, won't expose my private life to the eyes of the French," says Gouda, evoking Hollande's pledge a month before his election victory in May to not mix up his public and private lives.

Hollande's words were calculated to distance himself from his conservative predecessor Nicolas Sarkozy. He was criticized for letting his private life get too public during his presidency, divorcing his second wife Cecilia and marrying his third, former supermodel and singer Carla Bruni-Sarkozy while in office.

Two months after winning the election, it was Hollande in the seat answering an uncomfortable question on Bastille Day about his own love triangle. His 27-year-old son, Thomas, was dragged into to the affair, dubbed "tweetgate," to defend his mother, Royal.

Mirroring the image political satirists paint of Hollande, the play then shows the presidential character as incapable of controlling the two warring women who throw insults at each other

To chuckles, an exasperated Gouda says, "I never asked to be here... Why can't I just resign, like the pope?"

Actor Daniel Jean Colloredo, who plays the president, shows him to be a weak, ridiculous leader ? controlled by the characters around him including his aide who tries to teach him the confidence to say "I am a winner" to a mirror. He eventually manages with a weak "we-we-winner."

"He really doesn't have the strength of character to choose either woman," said Colleredo.

Hollande's ex-partner Royal was back in the news this week causing controversy, with an announcement of her appointment as vice president of the new government-funded Public Investment Bank.

Top business leader Laurence Parisot questioned Royal's experience for the job, while journalists have called it a political appointment from the Elysee to keep Royal happy ? a charge she vehemently denies.

The play also tries to address the key question on everyone's lips: What is the irresistible appeal of Hollande, who had been nicknamed "flanby" after a bland custard dessert?

"We asked ourselves this, too. How can this (love triangle) have come about?" says Dominique Merot, the actress who plays Loyal. "He must have a lot of charm behind closed doors.

Vatican accuses Italian media of false reports ahead of conclave

VATICAN CITY (Reuters) - The Vatican on Saturday accused the Italian media of spreading "false and damaging" reports in what it condemned as a deplorable attempt to influence cardinals who will meet in a secret conclave next month to elect a new pope.

Since Pope Benedict announced his resignation on February 11, Italian newspapers have been full of rumors about conspiracies, secret reports and lobbies in the Vatican that they say pushed the pope to abdicate.

"It is deplorable that, as we draw closer to the time of the beginning of the conclave ... that there be a widespread distribution of often unverified, unverifiable or completely false news stories that cause serious damage to persons and institutions," a Vatican statement said.

The Italian reports have painted an unflattering picture of the Vatican's central administration, known as the Curia, depicting it as being full of prelates more concerned with their careers than serving the Church or the pope.

Some Church officials, speaking privately, have said foreign cardinals coming to Rome to choose the next pope have been alarmed over reports of corruption and might be inclined to elect someone not connected with the Curia, which is predominantly Italian.

The Vatican statement said the Italian media reports were an attempt to influence the outcome of the conclave through negative public opinion much like states and kings tried to influence papal elections centuries ago.

The pope has announced that he will step down on February 28, becoming the first pontiff to abdicate in some six centuries.

The 85-year-old Benedict said his failing health no longer enabled him to run the 1.2-billion-member Roman Catholic Church as he would like.

DISCREDITING THE CHURCH

In a separate statement, Father Federico Lombardi, the Vatican spokesman, said the reports were trying to "discredit the Church and its government" ahead of the conclave.

Italy's Repubblica newspaper ran a series of unsourced stories this week about the alleged contents of a secret report prepared for the pope by a commission of three cardinals who investigated the so-called Vatileaks scandal last year.

Paolo Gabriele, the pope's butler, was convicted of stealing personal papal documents and leaking them to the media. He was jailed and later pardoned by the pope.

The documents alleged corruption in the Vatican and infighting over the running of its bank, which has been at the heart of a series of scandals in past decades.

On Friday the Vatican denied Italian media reports that Benedict's decision to send a senior official to a new post in Latin America was linked to the secret report about leaked papal papers.

The Vatican said the transfer to Colombia of Monsignor Ettore Balestrero, an Italian who holds a post roughly equivalent to deputy foreign minister, was a promotion and had been decided weeks ago. Balestrero will be promoted to archbishop and made ambassador in Bogota.

Those reports said Balestrero was being sent away from the Vatican because he figured in the secret report.

On Saturday, as part of his last activities before his resignation in five days, Benedict ended a week-long Lenten spiritual retreat in the Vatican and held a farewell meeting with Italy's president.

On Sunday he will hold his last Sunday blessing. He will hold his last general audience on Wednesday and meet with cardinals on Thursday morning before he resigns on Thursday.

He will first go to the papal summer retreat at Castel Gandolfo south of Rome and then move to a convent inside the Vatican in April after the building is renovated.

New Process Takes Energy From Coal Without Burning It

They just burn it with pure oxygen instead of with air. The innovation, and it is an innovation IMHO, is that they used iron to capture and transfer the oxygen. This prevents the forming of NOx, which is a good thing.
This means they can burn the coal hotter without emitting dangerous amounts of NOx.
1. They let iron pellets rust. Or they buy rust in the first place.
2. They put the rust pellets into the chamber with coal dust.
3. They ignite the mixture (this requires a bit more heat than usual burning. At least 1566 ?C or 2850.8 F)
4. The coal dust pulls the oxygen out of the rust and binds it with the carbon into quite pure CO2.
5. Heat (a lot of it)
6. Use the heat in a default thermoelectric power plant.
7. The pellets can rust again, to capture oxygen.
8....
9. Profit.

If they would combine it with an iron smelting plant then the energy required in step 4 to pull the oxygen out of the rust would not be wasted. Then the iron pellets are one of the end results. Of course, then you'd have to emit step 7.

To me this seems familiar. If I am correct this is the way Thermite works, just with aluminium powder instead of coal dust.

Wish the Golf TDI had a bit more oomph? Or that the Golf GTI had a little more low-end torque? Of course you do. That's why Volkswagen is continuing the Golf GTD for its upcoming seventh-generation Golf.

Unveiled today ahead of its official debut at the Geneva Motor Show next month, the GTD is the performance-minded diesel cousin of the original hot hatchback, the GTI. Carrying VW's latest 2.0-liter four-cylinder turbodiesel, the GTD puts out 184 hp, the most of any GTD since the name's debut in 1982. And because it's an oil-burner, its 280 lb-ft of torque is available at just 1750 rpm. Flat out, VW says the car can hit 0-62 mph in 7.5 seconds and will go on to 143 mph, a slightly faster top speed than the last-gen GTD.

Performance is only half of the equation. Mated to a six-speed manual (which is standard, by the way), the GTD attains an estimated 56 mpg. If you'd rather not row your gears and choose the six-speed DSG dual-clutch automatic transmission, you're rewarded with six fewer mpg.

In terms of styling, the GTD looks like you'd expect: a seventh-gen Golf with a lower suspension, sportier sideskirts, rear diffuser, and a roof spoiler. And if the previous GTD is a sign of things to come?and this is Volkswagen we're talking about here?then we're probably looking at the seventh-gen GTI here, too, since the styling won't change much.

Sadly, despite the American diesel revival, Volkswagen has no announced plans to bring the GTD to the U.S. While the official line from Volkswagen of America's is that they'd like to see the diesel come to the States, don't hold your breath.

Manhunt underway for suspects in fatal Las Vegas Strip shooting

(Reuters) - A multi-state manhunt was under way on Friday for the men who shot dead an aspiring rapper as he drove on the Las Vegas Strip in a Maserati, touching off a fiery crash that killed a cab driver and his passenger.

Las Vegas police have not named any suspects in the dramatic pre-dawn shooting in the heart of the desert resort city on Thursday, but said they were still hunting for a black Range Rover used in the incident.

One or more gunmen in the apparently brand-new luxury sport utility vehicle opened fire on a silver Maserati being driven by 27-year-old Kenneth Wayne Cherry Jr. at the busy intersection of Las Vegas Boulevard and Flamingo Road.

Cherry, who performed under the name "Kenny Clutch," was slain and his car veered out of control before smashing into a taxicab. Killed in the cab were driver Michael Bolden, 62, and a passenger who has not been identified by authorities.

Las Vegas television station KTNV reported that the taxi passenger killed in the incident was identified by her family as Sandi Sutton, a Washington state woman who worked for a Seattle-area chamber of commerce.

The gunfire and collision in the busy intersection near the Bellagio and Caesars Palace hotels triggered another crash involving four other vehicles. At least four people were hurt.

"As you can imagine our detectives are working non-stop," Las Vegas Metropolitan Police spokesman Officer Jose Hernandez said. "There's lots of information coming in, lots of leads being generated that we're sifting through, and our investigation is moving forward."

Hernandez said Las Vegas police had asked authorities in neighboring states to assist in the manhunt and to be on the lookout for the black Range Rover, which was described as carrying paper dealer plates.

He said a passenger in Cherry's car, who suffered a minor injury, had spoken to police.

Clark County Sheriff Doug Gillespie told a Thursday news conference that the shooting may have stemmed from an altercation between Cherry and the suspects in the valet area of the Aria Resort and Casino on the Strip.

Hernandez declined to elaborate on that incident, saying that it was part of the ongoing investigation.

Attorney Vicki Greco, who has represented Cherry for what she described as minor traffic issues and in a civil case, told Reuters that his family was "devastated."

"I can tell you this, the world has lost a good man," Cherry's aunt, Pat Sims, told the San Jose Mercury News for a story on its website.

"I'm not saying he didn't have his faults, but he was very kind, especially to older people," Sims, 75, told the paper. "Whatever happened in Vegas, I don't know about, but he was a very kind soul."

The incident occurred less than a mile from where rapper Tupac Shakur was shot in September 1996 while riding in a BMW with Death Row Records co-founder Marion "Suge" Knight after the two men had attended a Mike Tyson boxing match.

Shakur, 25, was hit by gunfire from at least one assailant in a Cadillac while sitting in Knight's car at the intersection of Flamingo Road and Koval Lane and died six days later at a hospital. His murder remains unsolved.

Once dubbed by prosecutors as the government's most wanted deadbeat parent, Robert Sand pleaded guilty Thursday to owing more than $1.2 million to three children.

A New York man once dubbed by prosecutors as the government's most wanted deadbeat parent pleaded guilty Thursday to owing more than $1.2 million to three children from two failed marriages.

Robert Sand, 50, pleaded guilty in U.S. District Court in Central Islip on Long Island to two counts of failing to pay child support. Assistant U.S. Attorney Alan Bode said in court that the child support orders, which were issued on Long Island, have been in arrears since at least 2002.?

The figure cited by Bode includes interest and penalties. The prosecutor declined to comment to reporters after the court proceeding.

Sand told the judge he fled first to Florida and then to Thailand. Sand's attorney, Glenn Obedin, said his client had grown tired of living on the run and contacted authorities late last year.?

Sand left Thailand, where he had worked in an assortment of odd jobs, and flew to the Philippines. He was arrested and then deported from the Philippines in November 2012 because he lacked proper identification, prosecutors said. He was sent to Los Angeles, where he was arrested by federal marshals, and then extradited to New York, where he has been held without bail since December.?

"He had enough and wanted to come back and have the opportunity to make it right," Obedin told reporters after the court proceeding on Long Island.?

Sand faces up to four years in prison when he is sentenced in May.?

"Neither court orders nor the familial bond meant anything to him as he fled to avoid his obligations," U.S. Attorney Loretta Lynch said in a statement.?

The two mothers of Sand's three children were not in the courtroom for Thursday's proceeding, but Obedin has said he has contacted them and claimed their priority is for Sand to be free to earn a living so he can repay his debt. As part of the plea agreement, Sand is required to make full restitution. He waived his right to appeal the guilty plea.?

Obedin said Sand has worked in the past as a car salesman and has an offer to work in that field when he is released.

    It's no secret that NVIDIA's Tegra 4 processor is missing from the new device announcements of late, but today ZTE is about to change all that with the announcement of their new line of "super phones" running the beefy new chip. 

    Available in China during the first half of 2013, these new devices are promised to offer "ultra-fast web browsing, improved app load times, more realistic gaming experiences and great battery life – thanks to the processor’s 72 custom NVIDIA GeForce cores and quad-core ARM Cortex-A15 CPU." In addition, the new i500 LTE enabled chipset, the phones will have the ability to provide world-wide LTE voice and data.

    PFT: McCoy says Rivers perfect face of franchise

    The process of the Eagles hiring Tom Gamble as their vice president of player personnel took longer than he hoped, but the former 49ers personnel man said the time was right this year.

    Gamble said there were several reasons why he wasn?t able to join the Eagles a year ago, but that his rare mid-offseason jump made sense this time. He interviewed with general manager Howie Roseman about the job formerly held by Colts GM Ryan Grigson last year, but was able to talk his way out of the 49ers for what amounted to a lateral move.

    ?The timing wasn?t right [last year] for a lot of different reasons, some professional, some family,? Gamble said, via Les Bowen of the Philadelphia Daily News. ?Then this whole thing came up again. I have enough relationship with Howie, enough dialogue. Living out in Pac 12 country, I?ve got a lot of respect for Chip Kelly ? I?ve been in and out of his [Oregon] building, he?s been in and out of [the 49ers'] building, I think he?s a hell of a football coach.?

    ?We chatted again, and you know what, it was time. I was real excited about it. Again, I wasn?t looking to go anywhere; I was in a great situation with some great people ? as good as it gets in this business.?

    The primary lure for Gamble was a return home. His father Harry was the Eagles president in the 1980s when the son got into the family business.

    ?It?s Philadelphia. That means something,? Gamble said. ?It?s a little bit different, this thing. There?s not a lot of movement, not a lot of opportunity. I didn?t know when it would come up again, and I was ecstatic to come back.?

    Gamble indicated that the 49ers were hesitant to let him leave a year ago, but agreed that if the opportunity presented itself again, they?d give him a chance.

    Gamble interviewed for other GM jobs, but even though he lacks that title in Philadelphia, he?ll have significant input. Roseman doesn?t have the classic personnel evaluation background, and with Kelly having no NFL experience, getting Gamble on board is a solid move for the organization.

    Elusive substrate protein identified in the most common form of heritable rickets

    Diagnosed in toddlers, X-linked hypophosphatemia (XLH) is the most common form of heritable rickets, in which soft bones bend and deform, and tooth abscesses develop because infections penetrate soft teeth that are not properly calcified. Researchers at McGill University and the Federal University of Sao Paulo have identified that osteopontin, a major bone and tooth substrate protein, plays a role in XLH. Their discovery may pave the way to effectively treating this rare disease.

    The findings were made by the laboratories of Marc McKee, a professor in the Faculty of Dentistry and the Department of Anatomy and Cell Biology at McGill University, and of Nilana M.T. Barros, a professor at the Federal University of Sao Paulo. The team built upon previous research that had shown that mutations in the single gene PHEX are responsible for causing XLH. The results of this latest research by Drs. McKee and Barros will be published in the March issue of the Journal of Bone and Mineral Research.

    "XLH is caused in part by renal phosphate wasting, which is the urinary loss from the body of phosphate, an important building block of bones and teeth, along with calcium." says Prof. McKee. "In pursuing other factors that might contribute to XLH, we used a variety of research methods to show that PHEX enzymatic activity leads to an essentially complete degradation of osteopontin in bones."

    This loss of osteopontin, a known potent inhibitor of mineralization (or calcification) in the skeleton and dentition, normally allows bones and teeth to mineralize and thus harden to meet the biomechanical demands placed on them. In XLH patients lacking functional PHEX enzyme, osteopontin and some of its smaller potent inhibitory peptides are retained and accumulate within the bone. This prevents their hardening and leads to soft deformed bones such as bowed legs (or knock-knees) seen in toddlers.

    While not life-threatening, this decreased mineralization of the skeleton (osteomalacia), along with the soft teeth, soon leads to a waddling gait, short stature, bone and muscle pain, weakness and spontaneous tooth abscesses.

    The fact that these symptoms are only partially improved by the standard treatment with phosphate which improves circulating phosphate levels prompted the researchers to look for local factors within the bone that might be blocking mineralization in these patients.

    "With this new identification of osteopontin as a substrate protein for PHEX," says Professor Barros, "we can begin to develop an enzyme-replacement therapy to treat XLH patients who have nonfunctional PHEX, much as has been done using a different enzyme to treat another rare bone disease called hypophosphatasia."
