The Assange Extradition: Curiouser... - International & Transnational ...

?

The extradition case of Wikileaks capo Julian Assange (about which I previously blogged here and here) is becoming a fascinating exercise in something I emphasize for the students in my International Criminal Law course: transnational criminal matters are a continuing interplay between the legal and the political.

The background: Assange has earned himself the enmity of the US (among other states, it should be said) due to Wikileaks' release of an enormous amount of material, some of which was classified diplomatic and security communications. Sweden then sought custody of Assange for questioning related to two alleged sexual assaults during a trip to Stockholm. Assange has maintained that the sex was consensual, and that the Swedish inquiry was actually a ploy to get him onto Swedish territory and from there extradited to the U.S. to face "secret" indictments (possibly for conspiracy to commit espionage). He was arrested in London under a European Arrest Warrant issued by Sweden, and went through an extradition process where the latter argument fell on deaf ears, the UK Supreme Court denying him?any recourse and ordering his surrender.

Just after that ruling, Assange sought asylum at the London embassy of Ecuador, whose president had earlier made remarks sympathetic towards Assange and Wikileaks (and, unsurprisingly, antagonistic towards the US). He has been living in the Ecuadorian embassy for the last five weeks, meeting with his lawyers and, presumably, watching the diplomatic wrangling play out between Ecuador, the UK and Sweden.

Coverage in a recent issue of the Guardian conveyed a great deal of information on current developments in the case, which I will cover and comment on below:

1) Ecuador has effectively granted Assange asylum, at least to the extent that it seems willing protect him until the "problem" is solved. Ecuador's senior legal adviser is quoted in the story as calling the potential re-extradition of Assange to the U.S. an "evil," so I guess we know where they stand.

2) on July 24, the Washington Post reported that Wikileaks and Assange had hired former crusading Spanish magistrate Baltasar Garzon to act for them, and specifically to advise on Assange's current situation. This is an extremely astute PR move -- Garzon has a great deal of international credibility, stemming most prominently from his having been the initiator of the extradition request that led to the UK House of Lords' decision regarding the extradition of Augusto Pinochet, an international criminal law high water mark if ever there was one.

3) on July 25, "Ecuador formally offered the Swedish prosecutor the opportunity to interview Assange inside the London embassy. Sweden ha[s] not responded to the proposal." This is another extremely astute move. Recall that Assange has not been charged in Sweden, and the Swedish prosecutor has been clear that he is simply being sought for questioning at this point (which is permissible under the European Arrest Warrant system). Earlier, Assange had volunteered to submit to questioning via video-conferencing, which the Swedish prosecutor rebuffed. This recent offer ups the ante somewhat, as the moving force behind the entire dispute has been Assange's suspicion that Sweden simply wants to get him into their territory so that they can re-extradite him to the US. To my knowledge, Sweden has not confirmed or denied this allegation, but if all they want him for is questioning, then doing it inside the Ecuadorian embassy should suffice. Of course, it's not quite that simple -- the Swedes are likely to want the Ecuadorians to consent to the Swedish law regarding questioning of a suspect being applied during the interview (a reasonable request), and it's possible that the British government might have to consent as well. Still, these don't seem like insurmountable barriers, and if the Swedish government rejects this offer, it will add credibility to the suspicion regarding a secret deal with the Americans.

4) the "senior legal advisor" has invoked the concept of "specialty." Under nearly all extradition treaties (and under the EAW), the requesting state is generally forced to agree that it will only try the individual regarding the crimes for which they were extradited by the requested state -- that is, the requesting state has an obligation to refrain from prosecuting on any other crime than that agreed to via the particular extradition request. Specialty is something of a hold-over from older extradition practice, but it's very interesting that it has emerged here. The Ecuadorians have asked the UK Home Secretary, Theresa May, whether she intends to waive specialty in this case, which is a prerogative of the requested state's government. The Foreign Office has not responded on May's behalf as of yet. It appears that part of Ecuador's plan to protect Assange will be to extract such a promise from the UK government as part of any deal to allow Assange to be sent to Sweden. Of course, if the UK and US governments are talking in the background, the latter has likely asked the former to waive specialty.

5) the UK Foreign Office has released a statement about the case, which is quoted in the Guardian story. The Foreign Office rather condescendingly indicates that it has explained to the government of Ecuador that the UK owes a binding obligation to Sweden to extradite Assange pursuant to the EAW, and notes that UK extradition law is replete with all the necessary human rights protections...so, essentially, they have nothing to worry about and should stop interfering. This is a bit disingenuous, in my view, because it simply doesn't address the re-extradition problem. Part of the argument would be that Swedish extradition law would ultimately be governed by the standards set by the European Court of Human Rights, and thus Sweden couldn't extradite Assange to face the death penalty in any event. However, this doesn't mean that he would not face a sentence of life without parole (regarding which, see below). ? On the other hand, this does give a reminder of the big stick that the UK holds in the background here -- they do have an obligation to surrender Assange to Sweden, and if he steps foot outside the Ecuadorian embassy, they will be within their rights to arrest him and put him on a plane.

6) someone identified as a "political advisor" to the Ecuadorian government is quoted in the story as expressing "deep concern" about the prospect of Assange facing the death penalty if extradited to the US, and also that Ecuador views a sentence of life without parole as "equally inhumane" to the death penalty. In international law methodology terms, we call that evidence of "opinio juris," the expression that a particular state practice (i.e. refraining from extraditing someone to face the death penalty or life without parole) is actually required under the law. While this is not as clear an expression of opinio juris as one might like, the use of the word "inhumane" does a fair bit of work, as this is a legal term of art in this area -- to wit, pursuant to the UN Torture Convention, states cannot extradite or refoule an individual to another state where they would face "inhumane treatment." The issue of whether states can lawfully extradite individuals to face life without parole is a hot one these days, and has been the subject of recent decisions from the European Court of Human Rights and the Quebec Court of Appeal.

7) final issue: as a matter of international law, does the US have any jurisdiction over Assange's alleged crimes to begin with? There has been no public indictment as of yet, so we can only speculate. Obviously, anything Assange did to attract US attention was not done on US territory. The most that can be offered is that states are permitted to exercise extraterritorial jurisdiction over crimes that attack the state's vital interests (such as espionage), pursuant to the protective principle of jurisdiction. We'll have to await some actual indication of what, if anything, Assange is charged with to assess whether there is any jurisdictional overreach.

In any event, this case is getting more interesting by the week, and is worth watching.

Many thanks to law student Jennifer Groenewold for alerting me to the recent developments.

Day two of Splendour more subdued | Bundaberg Music | Music ...

IT APPEARED many were struck down with a case of Splendour in the Grass fatigue with a noticeable shortage of midday revellers on day two of the three day festival.

Another glorious day was promised for Saturday but this time it delivered, with nothing but blue skies and hip tunes to keep the sold out crowd in good spirits.

The Supertop was overflowing with punters keen to stay up late for British rockers Bloc Party.

Front man Kele Okereke greeted the crowd with a "g'day" before launching into hits Mercury and Hunting for Witches.

American "sadcore" singer Lana Del Rey was nearly drowned out by her throngs of adoring fans in the G

Backed by a string quartet and piano, she opened her show with Blue Jeans and wasted no time walking down to the front of the stage to serenade her dedicated fans.

"I had to come down and see my people," she said.

"I'm really grateful and I adore you."

Dressed in a white dress and short veil, Del Rey was pitch perfect but her show suffered from a few sound problems including a scratchy mic.

She worked her way through most of the tracks on her album Born to Die and sang a cover of Nirvana's Heart Shaped Box before closing her set with National Anthem.

Meanwhile at the Mix-Up Tent, Gossling joined 360 during his high energy set to sing their collaboration Boys Like You.

Gold Coast bad boys Bleeding Knees Club opened the day on the Supertop.

Their surf pop antics enticed three young girls on stage to sing the chorus of "Girls Can Do Anything".

Indie boy bands continued to be a running theme.

Dublin charmers The Cast of Cheers and energetic Brisbanian four-piece Last Dinosaurs played to swelling crowds at the Supertop.

The latter commenting it was their biggest audience to date.

The GW McLennan kicked off with local lads Lifeline followed by a quiet set of thoughtful indie pop from Mosman Alder.

Here We Go Magic were a tad gloomy, looking every inch the uber cool New York outfit.

Their trippy melodies were a soothing fix for any early afternoon tiredness with many cosying up on the ground.

The Mix Up tent was again party central with Tijuana Cartel carving it up with their global dance beats.

New-to-the-scene hipsters Friends injected a bit of an R&B vibe to their set of sexy tunes and the sultry lead singer flaunted a Smashing Pumpkins T-shirt given to her by a fan.

Away from the music, festivallers were getting hitched in random, debauched ceremonies inside the Tent of Miracles.

Proceedings were overseen by a celebrant dressed in white leather and a very questionable Priest.

Triple j presenters John Safran, Tom Ballard, Kram of Spiderbait and Kav Tamperley of Eskimo Joe discussed music and religion in the Forum tent.

Drumming troupe the Samba Blissta's leant their instruments to enthusiastic crowd members and North Coast talent continued to shine on the Busker Stage with Mick McHugh and Mojo Bluesman among the four acts of the day.

Given the torrential rain and hail late Friday afternoon Belongil Fields was one big mud pit.

It was reported gum boots were sold out on site and some even braved the trip into Byron Bay where they were being sold in the street.

Police seemed to up the ante with several manning Gate 2 from midday and first aid tents didn't appear to be overflowing with people; a good sign attendees are staying safe and enjoying themselves.

Today?punters can look forward to sets by Metric, Triple j darlings The Rubens, Husky, Ball Park Music, Angus Stone, Wolfmother, Missy Higgins, Gossip and a festival-closing show by The Smashing Pumpkins.

Cheney Criticizes Palin Pick; Romney Dances Around Isreal Comments

Dick Cheney came out and said what everyone else already knew. He said picking Sarah Palin for Vice President in 2008 "was a mistake." "That one I don?t think was well handled," Cheney said.?In an interview that aired on ABC's?This Week with George Stephanopolous, Romney talked about what it's like to go through a Vice President search. "I sort of think of it as there are two lists. There is the big list. And it?s got a lot of folks on it," he explained. But, ultimately, to get the call the person has to be ready to take office in an emergency. "And the test to get on the small list has to be is this person capable of being president of the United States, and that?s usually a very, very short list," he said. Cheney said the considerations that a VP could boost your chance of winning shouldn't factor into the decision making process. "I think that that was one of the problems that McCain had," Cheney said. "I like Gov. Palin. I met her. I know her. She is an attractive candidate, but based on her background ? she had only been governor for about two years ? I don?t think she passed that test of being ready to take over." The rest of the interview will air on Monday.

Mitt Romney appeared on CBS's?Face the Nation?to clear up his position on Isreal and Iran. One of his advisors made headlines yesterday when he said Romney would support Israel if they decided to attack Iran in an effort to harm their nuclear program. Romney was a bit cagier with his answers.?"I respect the right of Israel to defend itself, and we stand with Israel," Romney said. "We're a nation -- two nations -- that come together in peace and that want to see Iran be dissuaded from its nuclear folly. Let me use my own words in that regard." Romney said he was being careful with his answers because he realized he was on foreign soil, and didn't want to create any more controversy.?"Because I'm on foreign soil, I don't want to be creating new foreign policy for my country or in any way to distance myself from the foreign policy of our nation," he said. "But we respect the right of a nation to defend itself."?Romney said everything should be done to keep Iran from obtaining nuclear weapons, and only after every other venue's been tried should we consider attacking. "If all those options fail -- and they have not all been executed, they've not all failed entirely at this stage -- if all those options fail, then we do have other options, and we don't take those other options off the table. But that's as far as I'm willing to go in terms of discussing this matter while on foreign soil."

Romney was also asked about the?new?Newsweek?cover?that calls him a wimp.?"If I worried about what the media said, I wouldn't get much sleep, and I've been able to sleep pretty well," he said.?"They tried that on George Herbert Walker Bush," Romney said Sunday. "He was a pretty great president and anything but."

Antonin Scalia appeared on Fox News Sunday and continued to say the mandate of the Affordable Health Care Act isn't a tax. "You don?t interpret a penalty to be a pig. It can?t be a pig," Scalia said.?"And what my dissent said in the Affordable Care Act was simply there is no way to regard this penalty as a tax. It simply does not bear that meaning."?Scalia also dismissed the reports saying John Roberts changed his decision from "no" to "yes" on the Obamacare ruling. "You shouldn?t believe what you read about internal court proceedings, because the reporter who reports that is either a) lying, which can be done with impunity because as you know we don?t respond, or b) that reporter had the information from someone who was breaking the oath of confidentiality, which means that?s an unreliable person. So, either way, you should not put any stock in reports about what was going on in the secrecy of the court," he said.

Dick Durbin doesn't think Congress can solve the debt problem in time for the November election. Remember last summer when everyone was terrified the U.S. was going to default on its loans and there was a huge battle to raise the debt ceiling? Yep, we're doing that again as soon as the election is over.?"Let me be honest with you ... in the next 100 days before the election, the political environment is not one for compromise and negotiation," Durbin said on CNN's State of the Union.?"If we are prepared, the day after the election to move forward with a plan that restores confidence in the economy and the ability of congress to react to it, it's going to be a positive thing for us. I think we can do it," he said. "With the president's leadership, we can come together. There's a bipartisan answer here that'll reduce the deficit and still create an environment for economic growth."

Sen. Kelly Ayotte hates that the President is planning on cutting defense spending. She said on State of the Union that she's appalled the President would use them as a bargaining chip in the debt negotiations.?"It makes me sick that some in Washington -- particularly some of the Senate Democrats -- want to play, and even our president, unfortunately, want to use our military as a bargaining chip," Ayotte said.?

Obama advisor Robert Gibbs used Mitt Romney's comments about the London Olympics to question whether or not he's ready to President on This Week. Gibbs said that Romney's comments about the London Olympics preparations being "disconcerting" were enough to "make you wonder whether or not he?s ready to be commander in chief."?

"Mitt Romney wondered aloud whether London was ready for the Olympics, and I think it?s clear that voters in this country wonder aloud whether Mitt Romney is ready for the world, and I think the world is not yet ready for Mitt Romney," Gibbs said.

In case you were wondering how much is going to be spent on advertising in this election, someone who analyses media spending is putting the ballpark figure at $3 billion.?Ken Goldstein, President of Kantar Media/CMAG made the prediction on State of the Union.?"We?ll have over $3 billion spent on just spot, local television ? that?s in all races from dog catcher to president," Goldstein said. "When you add in cable buys and national cable buys, that number is going to be more like $3.6 or $3.7 billion."

Minnesota cycle tour promises fitness and charity in a green fashion ...

One of the good trends that is being seen across the globe in last few years is the number of 10k and 20k runs, half-marathons and bicycle tours, which promote both a wonderful cause and a healthy lifestyle. The best thing about these for us though is quite obviously the fact that they are not something akin to a ?car rally? that will come with the added bonus of emissions and fuel consumption. There is indeed something lovely about riding a bicycle on a free stretch of road that passes through some lovely woods and across a lake or two. And the Minnesota cycle tour might offer all that and more.

Over 1000 riders kicked off the MS TRAM(Multiple Sclerosis?s The Ride Across Minnesota) at the Bemidji?s waterfront and the event not only helps raise awareness and funds that help fight the disease of Multiple Sclerosis, but also offer a wonderful example of how those afflicted by the disease and others too can stay fit and healthy. The event has so far already raised $12,000 and more is expected to come in the coming week or so.

About 12 riders in the event are suffering from MS and while many believe that it is a debilitating disease, those in the cycle tour are leading the way in showing them how one can lead a healthy life by kicking MS away in style. (Or should we say pedal away!) Of course, apart from the fun and the healthy habit, it obviously helps keep the planet in a healthy state as well? Everyone wins!

CNN chief Jim Walton calls it quits

NEW YORK (AP) ? CNN chief Jim Walton said Friday he is quitting, saying the company needs new leadership at a time its flagship U.S. network is suffering through some of its poorest ratings ever.

Walton built the company into a profitable international news organization in his 10 years as president of CNN Worldwide, and said it is on track for record profits this year. But the U.S. network is the most visible part of the business and is now entrenched in third place behind rivals Fox News Channel and MSNBC in prime time.

He announced the decision in an email to staff members on Friday. He said he'll continue working until the end of the year during the company's search for a successor.

Walton said he's been talking to his boss, Turner Broadcasting Chairman Phil Kent, about leaving since the first few months of the year. CNN is owned by Time Warner.

"There's always pressure," he said. "I've been doing this a long time and CNN has had its ups and downs, like all companies have had ups and downs. I feel really strongly about a number of parts of this company. We're having a really strong year internationally and in mobile. It's clear there's a lot of spotlight on CNN's U.S. performance and it's reasonable that there is that spotlight."

CNN's U.S. network had its worst-ever ratings for a second quarter, down 40 percent for some of its prime-time shows. The decline was particularly notable in May, when CNN faced tough competition from broadcast networks during a slow news period and its ratings were compared to a year earlier, in the aftermath of the Osama bin Laden killing.

It hasn't improved appreciably since then, with veteran newsman Wolf Blitzer often losing in the ratings to broadcast novice Al Sharpton on MSNBC. Piers Morgan's show has been a bright spot this month.

The network was also embarrassed by initially reporting incorrectly the U.S. Supreme Court's decision on President Obama's health care law, then taking longer to correct itself than Fox, which made a similar error.

CNN's ratings traditionally fluctuate based on the intensity of the news. Fox and MSNBC have insulated themselves from that problem somewhat through its partisan prime-time hosts. Walton has resisted this approach, believing CNN's strength lies in being a nonpartisan news source and the company's reputation would be damaged worldwide if the U.S. network changed.

Walton said he doesn't expect that to change after he leaves.

"We kind of know who we are and our corporate colleagues know who we are and there has always been great support internally that we're going to be a news organization," he said.

At CNN, "we want to be accurate above all else, we want to be timely ? first if possible ? we want to actually go to where the news is, not just subscribe to some agency's news feed and talk about it. We want to report the news from multiple sides, all sides, and without bias."

Walton, 54, began working at CNN in 1981 shortly after it started. His first job involved ripping paper scripts off wire machines and operating the TelePrompter for news anchors.

CNN has suffered from weak programming and fundamental changes in the way people get their information, said Frank Sesno, a former CNN Washington bureau chief and now a professor at George Washington University. The company needs to make programming compelling enough to draw viewers used to getting their news elsewhere first online, he said.

CNN should put its attention toward other ways of delivering the news, said analyst Brad Adgate of Horizon Media.

"I don't know what they can do to catch up with television," he said.

Jeff Bewkes, Time Warner chairman and CEO, said Walton took over an underperforming company in 2003 and tripled earnings, delivering an annual growth of 15 percent. Roughly half of the company's earnings come through subscription fees from cable and satellite companies, and they have been growing steadily worldwide.

"Jim has been instrumental in growing the business into the financial powerhouse it has become, while establishing the brand as the worldwide leader for television news," Bewkes said. "I respect him personally and professionally and support the decision he and Phil Kent have reached."

Kent said Walton has a track record of great judgment when it matters most. He "challenged the organization to think bigger, reach further, do better," he said.

"I think this company needs some new thinking," Walton said. "I've been doing this job I'm in now for 10 years and I'm ready for a change."

Apple Execs Are Starting To Feel Threatened By ... - Business Insider

Apparently Apple executives are really starting to get worried about competition from Amazon's App Store.

In a new piece about the ongoing rivalry between the two tech giants, The Wall Street Journal drops this little tidbit:

Apple is also paying close attention to Amazon's app store, according to developers, who said Apple executives have told them they think Amazon's controlled, iTunes-like approach makes it more competitive than other app stores, including one operated by Google Inc.

That might sound odd at first considering that Amazon's App Store had just more than 30,000 apps as of March of this year, while Apple's App Store currently has more than 650,000 apps.

However, Amazon does have a leg up on some of Apple's other competitors in the app market in part because its model is so similar to Apple's. Amazon has reviewers who decide whether an app gets accepted into the app store (unlike Google), which ensures a certain amount of quality control. Amazon also has a huge existing customer base already, most of whom have credit card information on file with the company (like Apple), which makes it easier for them to make purchases in the app store.

Indeed, at least one study has already shown that Amazon's app store generates more revenue per user than Google, and not that much less than Apple. This, in turn, could help the company attract more app developers who are frustrated with the difficulty of making money with Android. Amazon is already ramping up the process of actively courting developers as is.

It still seems premature to view Amazon's app store as a big threat to Apple, but considering that Amazon is reportedly looking to compete more with Apple in the future by launching a larger Kindle Fire tablet and a new smartphone, Amazon's app store could pose a bigger threat down the road.

USA steamrolls Spain in Olympics tuneup: Did Spain tank on purpose? (+video)

The US men's basketball team dismantled Spain ? supposedly its biggest challenger in London ? 100-78 Tuesday in Barcelona. But Spain might still have something up its sleeve. ?

By Mark Sappenfield,?Staff writer / July 24, 2012

Carmelo Anthony of the US Olympic basketball team (c.) dives for the ball against Serge Ibaka (l.) and Pau Gasol of Spain during an exhibition match between Spain and the United States Tuesday in Barcelona, Spain, in preparation for the 2012 Summer Olympics.

Did the Team USA just announce itself as the prohibitive favorites heading into the London Olympics, or was Spain playing possum?

We'll probably have to wait until a potential matchup in the final to find out. And that could be just the way the Spanish like it.?

Based on the evidence from Tuesday's 100-78 thrashing in Barcelona, the Spanish threat to America's gold-medal defense in men's basketball would appear to be something along the lines of a pop gun arrayed against an armored tank unit (LeBron James, of course, being the tank). Then again, all the evidence is that we don't have all the evidence.

Before the game, there were noises that Spain was not going to try to win. American Kobe Bryant barked that Spain would be mad not to take this game on the 20th anniversary of the Dream Team's gold-medal run in Barcelona seriously.

"They're at home, man. They have to play us [hard]. You think they can just come out and lose in front of their own fans?"

The answer to that question, it appears, is "yes." Emphatically.?

It may transpire that the US is better than Spain. Perhaps significantly better. It is hard to imagine, however, that it is 22 points better ? in other words, that Spain is go-back-to-Barcelona-with-your-tail-between-your-legs worse.?

Which brings us back to the question of whether Spain pulled its punches.?

By not playing Marc Gasol, who is nursing a minor injury, it certainly pulled at least one.

And it's not inconceivable that there were more.

In truth, what advantage would Spain gain in actually winning this game? There is little doubt that the US is the better team. With its size, Spain can cause the USA problems, but they are not problems without solutions for the American team. The US, meanwhile asks questions that other teams cannot consistently answer.

For instance, who guards James, much less the rest of the US backcourt??

How do you counter the speed and athleticism of the US defense?

To win Tuesday's game would mean answering these questions, and to answer these questions would be to provide the blueprint for beating the US ? and to allow the US coaches and players 2-1/2 weeks of planning to counter it.?

Spain's Pau Gasol hinted at this before the game, saying of Bryant, his teammate on the Los Angeles Lakers: "I'd like to maybe let him win tomorrow and maybe beat him in London. That would be ideal."

The fact is, Spain probably has only a puncher's chance of beating the US ?In London.

It is no wonder, then, that perhaps it did not throw that punch in Barcelona.?

London Olympics won't save the UK's economy

The London Olympics will bring tourism money and higher prices, but it won't be enough to ebb the tide of economic decline for Britain.

By Stefan Karlsson,?Guest blogger / July 26, 2012

Two police officers patrol at St. Pancras Station in London, Thursday, July 26, 2012. Karlsson argues that the influx of money from the London-histed Olympic games won't do much to help a declining UK economy.

Second quarter U.K. GDP was even weaker than I, and almost all other analysts, thought it would be, contracting by 0.7% (2.8% at an annualized rate) compared to the first quarter and by 0.8% compared to Q2 2011. The drop reflected to some extent effects of the Queens Diamond Jubilee and could also to a small extent be an illusion reflecting a lack of adjustment for terms of trade improvements, but there is little doubt that there is a real underlying contraction.

The fact that the Queens Diamond Jubilee was a one time event that will be reversed will be positive for the third quarter number. But what about the soon upcoming Summer Olympics that will be held in London?

Well, that too will provide support as it will increase the number of tourists in the London area and also enable for example hotels and hostels to charge higher prices. ?However while the Olympics and the reversal of the Queens Diamond Jubilee might provide enough support to push third quarter growth above zero they won't end the underlying decline especially as exports are hit by the reduction in demand from the debt crisis and by the overvalued pound.

Bikini-clad beach volleyball players to frolic on PM's doorstep

Bikini-clad beauties battling for Olympic gold will bring a new excitement to the Horse Guards Parade, hallowed grounds that annually host the Trooping of the Colour on the Queen's official birthday.

Beach volleyball will be contested practically on the doorstep of British Prime Minister David Cameron starting Saturday, with Americans Kerri Walsh and Misty May-Treanor seeking an unprecedented third consecutive women's title.

"We have played really well," said May-Treanor, who turns 35 on Monday. "Kerri and I feel in our hearts we are a threat and we can win this."

Together with US rivals April Ross and Jennifer Kessy, they considered the possibilities of members of the British Royal Family appearing to watch.

"Prince Harry! Yes, we've been tweeting," Ross said, quickly confessing that she was joking. "It would be great to see Harry at our sport. Or Kate."

"We would be available for tea also," Kessy noted.

"Any of the Royal Family would be fun," May-Treanor said. "Their interest is important. They would bring the rest of the country."

Bikini-wearing women playing volleyball on 5,000 tonnes of sand from a quarry in southern England might bring a few viewers on their own, even though women's matches start as late as an hour before midnight, when it can get cold.

"We are allowed to wear different gear when it gets too cold. That keeps us warm," May-Treanor said.

"But if it's the same as it has been, we'll wear our bikinis. It was warm at 11 at night," Ross added. "We'll try to go in bikinis unless weather dictates more discreet outfits.

"We grew up in California and this is what we have worn all the time. We wouldn't be playing in shorts. You get sand everywhere. It's not comfortable."

Horse Guards Parade, which dates to 1745, was named for the soldiers that have guarded the royal monarch since 1660 and serves as the staging ground for the pagentry of the Queen's official, and bikini-free, birthday bash.

"I'm not going to cut down the trees at No. 10 (Downing Street) so I can get a better view, though there is an enormous temptation," Cameron joked last year when learning his living quarters would overlook the 15,000-capacity venue.

Beach volleyball allows more modest attire so athletes of faiths requiring body covering can participate.

"We think it's a great thing," Kessy said. "We want women of all different religions to be able to play our sport so the fact they can wear more modest gear is great."

Defending men's Olympic champions Todd Rogers and Phil Dalhausser of the United States understand the women are going to take the most attention.

"I'm perfectly OK with it," Dalhausser said. "They're way prettier than us."

"Wait until you see their outfits," Ross noted.

May-Treanor, who ruptured her left Achilles tendon while on "Dancing With the Stars", vows she will retire after the Olympics.

"I felt like in Athens I had completed everything I wanted to do," she said. "Beijing I took the blinders off. It was the icing on the cake.

"This is my hot chocolate."

Penn State president says 4-year ban was floated

(AP Photo/Alex Brandon, File)

Penn State faced the threat of a four-year ban on playing football before the NCAA imposed sanctions this week over the school's handling of the Jerry Sandusky child molestation scandal, a university spokesman said Wednesday.

David La Torre said the potential for the multiyear "death penalty" was floated during discussions between Penn State President Rodney Erickson and NCAA officials before Penn State was hit Monday with a $60 million fine, a four-year bowl game ban, reduced football scholarships and the forfeiture of 112 wins.

The school trustees met on the subject at a State College hotel Wednesday, and afterward issued a statement calling the NCAA punishment "unfortunate" but better than the alternative ? the so-called "death penalty." Reporters were barred from the conference room where they met, and trustees avoided them after the meeting broke up.

The potential for a four-year ban, first reported by ESPN, showed how high the stakes were as college sports' governing body considered how to respond to an internal school investigation by former FBI Director Louis Freeh that found former coach Joe Paterno and three other top college officials helped conceal reports that Sandusky was abusing children.

NCAA president Mark Emmert said this week that if a total football ban had been imposed, other penalties would have accompanied it.

"If the death penalty were to be imposed, I'm quite sure that the executive committee and I ... would not have agreed to just the death penalty. It would have included other penalties as well," Emmert said as the sanctions were unveiled.

An NCAA spokeswoman declined further comment Wednesday on negotiations with Penn State.

Many alumni and some trustees were incensed over the unprecedented NCAA penalty ? which will cost Penn State tens of millions of dollars and likely cripple its football team for years to come ? and Penn State's quick acceptance of it.

A person with knowledge of the meeting said earlier Wednesday that trustees were to discuss whether Erickson had the authority to agree to the sanctions without first getting the board's approval. The person was not authorized to discuss the meeting and spoke on condition of anonymity.

Some trustees had expressed concern that Erickson may have violated a board rule that says the board must authorize the signing of "contracts, legal documents, and other obligations."

The board statement made no reference to the proprietary of what Erickson had done, saying trustees held a discussion but did not take any votes.

"The board finds the punitive sanctions difficult and the process with the NCAA unfortunate," the statement said. "But as we understand it, the alternatives were worse as confirmed by NCAA President Mark Emmert's recent statement that Penn State was likely facing a multi-year death sentence."

La Torre said Wednesday that Erickson had authority to act without the approval of the full board.

No Ordinary Love with Juan & Gee Long Distance emotionally ...

Long Distance emotionally attached!

?So I recently met this guy during a convention out of town. We happen to make eye contact and decided to exchange numbers the conversation was short due to the fact that he was on his way to the airport. Fast forward we live in separate cities but we are beginning to have feelings for each other. How should I continue a long distant relationship with the uncertainty that moving is an option??

Dear Long Distance Lover,

At the risk of sounding jaded our first inclination is to advise you to RUN FOR YOUR LIFE!? Long distance relationships NEVER WORK, especially those that start off as such.? But after we have calmed a bit and are able to think rationally, we still think that you are in for an uphill battle but the road might not be as bumpy as you think.? Don?t get us wrong, it is definitely hard to get to know someone and try to establish a solid foundation while living in separate cities.? You can?t truly get to know them on weekend visits because everyone is on their best behavior; ?in vacation mode.? But who is he when he goes back home?? What happens if you invest all of this time and energy into a long distance relationship, only to then move to the same city and discover a new person that you do not like?? Not to mention the lonely days and nights you will spend because of your commitment to a long distance union.? It?s a bit different if you are in a relationship with someone and unforeseen circumstances causes one of you to have to move away, because you already have a solid foundation to build upon and to sustain you.

Now with this being said, we also feel you can?t help where you find love.? So who are we to say do not pursue a long distance relationship with someone who can potentially be the love of your life? ?If the feelings are that strong to be with one another, this can still possibly work.? However, in order to make it happen it will take a lot of effort from you both.? Relationships are already a lot of work within itself, but to build and maintain one that is long distance will be a bit more taxing.? We do wonder why moving is not an option for either of you.? Relationships take sacrifice and for one that is long distance, someone will have to eventually sacrifice their currently living situation to continue to grow and develop the relationship.

One of the first things you and your long distance love must agree upon is where you would like to see the relationship go and how long you are both willing to continue the relationship long distance.? Once this has been established, the four tips below will help you to maintain your relationship while living apart.

1.? Communicate ? We all know communication is the key to any successful relationship.? However, when dealing with one that is long distance, communication is all you have and makes it even more important.? Be sure to open up to your partner about worries, doubts or insecurities that could affect your long distance relationship.? We are all human and are bound to be plagued by insecurities but the way to get past them is to be transparent and to allow each other to help.? Also, have regular check-ins with your partner on your relationship?s status and reevaluate your shared goals and plans as necessary.

2.? Spend Quality Time ? Sometimes, a long drawn out phone call every night can quickly begin to feel burdensome, leading to resentment. Try to stay in touch with your partner throughout the day instead of scheduling marathon phone calls.? Send a quick email or text to say ?I love you? or just let him know you?re thinking of him. Take the time to listen to your partner about what is happening in his life, and to do whatever he needs to feel assured of your commitment. Try to visit as much as possible and don?t worry about scheduling events for the entire stay.? Spend time just being together doing ?nothing?.? We all need intimacy, so find creative ways to do that.? Be creative.? With video chat and other technologies, it shouldn?t be hard to achieve this.? Even watching a movie together over the phone can be a bonding experience.

3.?Trust Each Other ? Don?t give him any reason not to trust you.? Being far apart from one another can create uncertainty and conflict when you let your imagination get the best of you.? Keep your insecurities in check and help your partner do the same by ensuring him he has no reason not to trust you.? Don?t keep secrets even if you think they are harmless.? It?s better to find out something from you than another person.

4.?Live your life ? Don?t stop living because you are in a long distance relationship.? Get a hobby, take a class, exercise and spend time with family and friends!? Meet new people!? Develop yourself spiritually!? You will be a much better partner when you have a full, healthy life.

Good Luck!

Ways to Reduce High Blood Pressure | Nash Tipoff - Fitness World

A diagnosis of high blood pressure, or hyper-tension, can be a prompt to make positive changes in your life. With hindsight you can see the bad news was a positive rather than a negative.

The things which cause high blood pressure are by and large the things that we know are bad for us. We acquire habits in younger life when the risk to health seems distant. They then become entrenched over the years. The diagnosis of hypertension is a good reason to look at the way we live, and think about some changes for the better. ?They do not have to be all that painful or difficult.

Your doctor will advise you that there is a marked correlation between alcohol consumption and high blood pressure, although the mechanics of the link are not well understood. Nonetheless the connection is there, and the best advice is to drink strictly in moderation.

That is sensible advice for the middle-aged in all sorts of ways. As we grow older, our toleration for alcohol declines. The habit of regularly drinking to excess, if not curbed in middle age, can lead later to other health problems, for example dementia, as well as to high blood pressure. The low cost of alcohol means that high consumption barely makes a dent in the budget of many middle aged drinkers, so the temptation is to carry on as though one was still seventeen. A psychological dependence can develop without one being fully aware of it.

The good news is that there is no need to cut alcohol out completely. A low to moderate amount of red wine is actually recommended in the latest research, but a routine of two alcohol-free days a week is also highly recommended. So we can drink a couple of glasses of red wine or beer, on up to 5 nights a week, and be fairly confident that our level of consumption is safe.

?

?

Your doctor will also recommend exercise. Walk part of the way to work every day. Be as active as you can in small ways. Go or a walk at lunch-time. It is unhealthy for your heart if you spend a large part of each day sitting down, so do whatever you can to keep in motion. A person who is desk-bound can still make an effort to move around to the maximum degree possible. Every little really does help.?Ideally you should do some harder exercise as well, get yourself a gym membership and set yourself healthy fitness goals.

High Intensity Training involves short bursts of very hard exercise, and recent research rather surprisingly suggests that as little as three minutes in total of such exercise per week can radically improve fitness and cardio-vascular function.

?

  • Be More Aware of Your Diet

?

Reduce your salt intake. That means eating less pre-prepared food which tends to be very high in salt. Use ?low sodium? salt at table and for cooking. It only takes a few days to get used to a lower level of salt in food: this is a change which really becomes painless in a very short time.?Consumption of fresh fruit and vegetables is also associated with good cardio-vascular health so keep an eye on your daily consumption, and keep your fruit bowl filled.

?

  • Find ways to reduce stress

?

Studies have suggested that the practice of transcendental meditation has a marked and measurable effect on blood pressure. There have been a number of studies which support the hypothesis, which prompted a meta-analysis by Anderson J. W. and others (Blood pressure response to Transcendental Meditation) reported in the American Journal of Hypertension 21 (3): 310-6, 2008. The meta-analysis evaluated the quality of the various studies of the topic, and looked at the strength of the overall conclusions.

The authors concluded as follows: ?The regular practice of Transcendental Meditation may have the potential to reduce systolic and diastolic blood pressure by approximately 4.7 and 3.2 mm Hg, respectively. These are clinically meaningful changes.?

There is no need to subscribe to any particular belief set in order to reap the benefits of meditation: it is a technique whose effect is to calm and de-stress the mind.

If the mystical associations of TM are too off-putting, then try to devote fifteen minutes a day to complete calm and unwinding. Don?t think about the past or the future: just concentrate on enjoying the here and now. Some play or grooming time with your pet may help: animals live in the present.

If you haven?t got one, consider getting a pet. The love, physical activity and sociability involved in caring for a pet have been shown to improve cardio-vascular health and promote longevity. Dogs have the greatest impact, but all pets bring health benefits.

?

?

?

***These suggestions are no more than common-sense, but they are all supported by good evidence. The point is to realise that knowing what is good for you is not the same as practising it. There is no time like the present for actually making these changes.****
