Columbia Prof of gender and sexuality law opines on public sex ...

Columbia University may want to ask Katherine Franke to stop making public statements. While opining on the recent sex scandals of David Petraeus and Kevin Clash who provides the voice of Sesame Street?s Elmo character, Franke suggested that both men are ?victims? of sexual panic.

From there, Ms. Franke just kept digging herself deeper.

Columbia Prof Minimizes Scandals

Columbia University has a ?director of the center for gender and sexuality law? by the name of Katherine Franke who is considered an authority on sexual matters by The New York Times. Her position seems to be that recent scandals in the news are not really scandalous, except in terms of being sensationalized and overblown by the media. She?told the paper?that Kevin Clash and David Petraeus were victims of a ?sex panic? when they resigned from their respective positions.

The Times story written by Elizabeth Jensen and Brian Stelter is noteworthy for the claim that Clash, the man behind Elmo of ?Sesame Street? fame, is merely accused of having ?underage sexual relationships.? This is how the New York Times refers to homosexual pedophilia and child sexual abuse.

Franke, a lesbian law professor,?believes?that children ?are sexual beings? and that ?gay children? in particular need to learn more about ?healthy sexuality.?

Strangely enough, the treatment of these scandals coincided with the appointment of a new CEO of The New York Times, Mark Thompson, who has raised eyebrows by issuing a denial that he was involved with suppressing a child sex abuse scandal while in his previous position as Director General of the BBC.

Cecil Singleton, who filed the complaint against the Elmo puppeteer, says that he was 15 years old when he engaged in ?sexual encounters? with Clash, who was then in his 40s. Another accuser, who later recanted, said he was 16 when he engaged in sexual acts with Clash, then 45. Clash is now 52.

In the matter of David Petraeus, the retired general and former CIA director, he is 60 years old and his mistress, Paula Broadwell, is 40. The difference of 20 years means that Broadwell is young enough to be his daughter.

Nevertheless, on her ?Gender and Sexuality Law blog,? Franke?said?that rather than hold Petraeus accountable for ?marital infidelity,? he needs to be called to account for ?alleged war crimes and crimes against humanity? that he carried out as a military commander in the Middle East.

Franke also made?headlines?when she joined a boycott of Israel, which has very liberal gay rights laws, over its treatment of Palestinians.

The Times article quoted Franke as saying that Kevin Clash ?has not been convicted of a crime, but merely accused of one in a completely unsubstantiated, vague complaint.?

The?complaint?against Clash is anything but vague, however. It describes how Clash began communicating with Singleton in a ?gay chat room? and then showered him with money and nice dinners before engaging in sexual activities over a period of several years.

Singleton?s attorney, Jeff Herman,?said?the suit refers to a pattern of activities. ?According to our lawsuit, Kevin Clash preyed on vulnerable teenage boys, like Cecil Singleton, to satisfy his depraved sexual interests,? he said.

On his blog, Herman?said, ?The media investigation into this story is still in its very early stages, but I must say I am disappointed in the coverage so far.?

He explained, ?From the Associated Press to the Wall Street Journal, some of the nation?s most well-respected media outlets have improperly labeled the allegations as ?an underage relationship? or ?an affair with a minor.? Whether Clash is guilty or not, the allegation that a 52-year-old man had sex with a minor is an allegation of child sexual abuse?not an underage relationship. To frame these allegations as a ?relationship? or an ?affair? is to imply that the alleged victim consented.?

He notes that ?a minor cannot actually consent to have sex with an adult.?

The Associated Press story appeared in The Washington Post under the headline, ?Elmo puppeteer Kevin Clash accused of underage relationship, taking leave from ?Sesame Street.?

The Wall Street Journal story appeared under the headline, ?Elmo Puppeteer Kevin Clash Accused Of Affair With Minor.?

A Google search turned up dozen of references to alleged ?underage? relationships involving Clash, rather than homosexual pedophilia or child abuse.

Clash has been?quoted as saying?that he is homosexual and that the relationship with his first accuser was legal and consensual. He ?did not dispute the charges? in the Singleton case, as noted by USA Today, and instead issued a statement that ?Personal matters have diverted attention away from the important work Sesame Street is doing, and I cannot allow it to go on any longer. I am deeply sorry to be leaving and am looking forward to resolving these personal matters privately.?

PBS?s Sesame Workshop played down the serious nature of the allegations, issuing?a statement?which said:

?Sesame Workshop?s mission is to harness the educational power of media to help all children the world over reach their highest potential. Kevin Clash has helped us achieve that mission for 28 years, and none of us, especially Kevin, want anything to divert our attention from our focus on serving as a leading educational organization. Unfortunately, the controversy surrounding Kevin?s personal life has become a distraction that none of us want, and he has concluded that he can no longer be effective in his job and has resigned from Sesame Street. This is a sad day for Sesame Street.?

Accusing Sesame Workshop of ?whitewashing pedophilia? and a ?sickening? response to the scandal, J. Christian Adams?commented, ?Let?s deconstruct the statement. First the praise: ?Kevin Clash has helped us achieve that mission for 28 years.? Really? What will PBS do when we learn that Clash?s access to children through Sesame Workshop may have resulted in abuse the same way Jerry Sandusky?s access to kids at Penn State did? Will PBS stand by Clash the same way the statement does??

He added, ?Pedophiles notoriously enter professions that give them access to children. Like a fisherman with a lure, they rely on puppets, football tickets, candy, balloons, toys and worse to attract victims. Did Clash?s ?achievement? of the PBS ?mission for 28 years? have a darker side? It seems strange that his employers would tout his good work.?

As AIM has?reported, Sesame Workshop received direct government grants of $7,968,918, in 2009, the most recent year for which figures are available, and reported lobbying expenses of $1 million a year, in order to keep the federal dollars flowing.

The ?good old days? are now: today's home appliances are cheaper ...

Thanks to ongoing advances in energy-saving technologies, the chart above shows the significant increases in the energy efficiency of five common?home appliances?based on?historical data that were just released by the Association of Home Appliance Manufacturers?(AHAM) for the years 1981 to 2011.?Those improvements in energy efficiency translate into significant energy cost savings for American households. According to a press release from the AHAM, U.S. consumers could save $90 per year on average if they replaced their 10-year old refrigerator, clothes washer and dishwasher with today?s energy efficient models. The savings from lower operating costs would be even greater when comparing today?s?modern models?to the appliances of 20 or 30 years ago.?

The energy efficiency of appliances is measured by their ?energy factors,? which are standard industry and government metrics that are used to measure an appliance?s overall energy efficiency. For example, the energy factor (EF) of a clothes dryer is defined as the number of pounds of clothes dried per kWh of power consumed. Definitions of the energy factors for other appliances can be found here.

In 1981, the energy factor of a typical home refrigerator was 5.59, and by 2011 the EF increased more than three-fold to 15.50, for a 207% improvement in energy efficiency in the last 30 years (see chart). The other four home appliances tracked by the AHAM?also had significant improvements in energy efficiency since 1981 based on the increases in their EF ratings. Compared to 1981, the energy efficiency of the average room air-conditioner has increased by 46%, today?s freezer is 65% more efficient, and modern washing machines and dishwashers are more than twice as energy-efficient.

As one example of how technology has improved the energy efficiency of appliances, today?s dishwashers consume less than half the energy of the 1981 dishwasher because of technological advances in soil sensors that minimize water usage, and the increased use of stainless interiors that accelerate drying time.

If the energy efficiency of the average dishwasher more than doubled since 1981, what has?happened to its price, measured by the number of hours a typical American factory worker would have to?toil at the average hourly wage to earn enough income to purchase a standard model?? The time-cost today is only one-third of the time-cost 30 years ago, as the comparison below shows.

In 1981, the dishwasher pictured above from a 1981 Wards Christmas catalog?sold for $359.88. The average hourly manufacturing wage?then was $7.42, meaning that it would have taken?48.5 hours of work at the average hourly wage for a typical factory worker to earn enough income thirty years ago to purchase the dishwasher above.

The?new Frigidaire dishwasher above is currently listed on the Best Buy website for sale at $299.99. At the current average hourly wage of $19.79 for production workers, the average manufacturing worker would only have to work about 15 hours to earn enough income to buy today?s energy-efficient dishwasher, which is less than one-third of the?48.5 hour time-cost for the 1981 model.

Bottom Line:?Today?s modern household appliances are not only cheaper than ever before, they are the most energy-efficient?appliances in history, resulting in additional savings for consumers?through lower operating costs. The average dishwasher today is not only more than twice as energy-efficient as a comparable 1981 model, but its cost today is only about 1/3 the price of the 1981 dishwasher, measured in what is ultimately most important: our time. Put those two factors together, and the average American?s dishwasher today is about six times better than the dishwasher of thirty years ago.

Stated differently, if dishwashers hadn?t fallen in price by a factor of?three since 1981, and if they hadn?t improved in energy efficiency by a factor of more than two, Americans today might be paying more than $1,000 for a basic dishwasher instead of $300, and it would take more than twice as much energy to operate. Likewise, we would expect comparable large decreases in the amount of work time required to buy the other four appliances, along with significant reductions in operating costs due to their increased energy efficiency.

Put it all together and American consumers have never been better off when it comes to the standard home appliances that we all own and take for granted: today?s appliances are cheaper, better, and more energy-efficient than ever before.

Today?s affordable and energy-efficient?household appliances are part of the ?miracle of manufacturing,? which continues to deliver cheaper and better goods to American consumers year after year, which translates into a higher standard of living for all Americans, especially for lower and middle-income households. If we wanted to identify a ?golden era? of prosperity for middle-class America?based on the affordability of common household appliances, today?s consumers are many times better off than the consumers of any past decade, including the 1950s that Krugman?and others wax so nostalic about.?The ?good old?days? are now.

Federal Judge blocks Xbox ban, grants motion to dismiss Motorola injunction

Motorola's hopes of enforcing a German-won sales injunction against the Xbox 360, Windows 7 and other products have yet again been dashed -- a Federal judge has taken Microsoft's side. Judge James L. Robart granted a motion declaring that Motorola Mobility isn't entitled to injunctive relief, effectively blocking bans based on the firm's H.264 streaming and (previously dropped) WiFi patent complaints. The court had been sitting on the motion for nearly a year, but for Microsoft, the final word is worth the wait: Motorola "has not shown it has suffered an irreparable injury or that remedies available at law are inadequate to compensate for its injury," the court said, noting that Microsoft "will pay royalties under any license agreement from the time of infringement within the statute of limitations." Basically, Motorola will recoup all the scratch it's complaining it lost anyway, so no harm, no foul. Just a giant legal headache.

The War on Christmas is in full swing, folks. And the latest battle occurred last night on The O?Reilly Factor.

O?Reilly brought on David Silverman, President of American Atheists, to set up a manufactured debate over the place of Christmas in society, particularly when sponsored by agencies of the government. In the heated exchange, O?Reilly frequently bellowed at his guest whom he called a ?fascist? at one point. But the segment?s most surreal moment came when O?Reilly sought to make the argument that public displays of faith on government property are permissible because?

Yikes! That?s a rather astonishing declaration. I wonder if Christians know that what they are practicing is philosophical, not religious. Among the repercussions of this revelation is that Christianity would not be protected by the First Amendment which prohibits Congress from ?respecting the establishment of religion.? The Constitution says nothing about philosophies.

Just to be clear, Here is the definition of each from the Merriam-Webster Dictionary

It seems to me that Christianity fits squarely in the definition of religion with its worship of God and devotion to faith. Philosophy, on the other hand, explicitly excludes Christianity as a theology.

O?Reilly has said some idiotic things on this subject. Like when he wrote in his auto-bloviography ?Next time you meet an atheist, tell him or her that you know [me]. Then ask him or her if they still don?t believe there?s a God.? But this makes no sense at all. It is an insult to his audience who are not likely to be pleased that their religion has been downgraded. They will surely chafe at their savior being lumped in with the likes of Aristotle, Confucius, Nietzsche, and Sartre, none of whom walked on water or rose from the dead (that we know of). And if supporting the Constitution?s principles of equality and free expression make you fascist, then there are tens of millions of American fascists. Don?t anybody tell O?Reilly or he?ll start a war on the Constitution.
